These Terms are a legal agreement between you and FunSpace OÜ (referred to as “the Company”, “we”, “us”, or “our” in these Terms). The Terms set out how you may use our website birdsrescuegame.app (“Website”), other dedicated websites, our apps, or any games, products, forums, and services we offer through our apps or otherwise on any platform (all collectively referred to as our “Services”).

By using our Services, you agree to accept and be legally bound by these Terms. If you do not agree, you must not access or use our Services.

2. Governing Law & Consumer Rights

These Terms are governed by the laws of Estonia and applicable European Union legislation, including but not limited to:

• Directive 2005/29/EC on unfair commercial practices

• Directive (EU) 2019/770 on contracts for the supply of digital content and services

• Directive 93/13/EEC on unfair terms in consumer contracts

Nothing in these Terms affects your statutory consumer rights under EU or national law.

If you are an EU resident, you have the right to bring claims before the courts of your country of residence.

3. Dispute Resolution

If we cannot resolve the matter directly, you may refer it to the European Commission’s Online Dispute Resolution (ODR) platform:

You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
You must not share your account with others or allow unauthorized use.
We reserve the right to suspend or terminate accounts that are used in breach of these rules.

6. Prohibited Conduct

You must not use our Services to:

• Harass, threaten, or abuse others

• Share illegal or harmful content

• Cheat, hack, or use unauthorized third-party software

• Infringe intellectual property rights

• Promote illegal activities or regulated goods (e.g., weapons, drugs)

• Engage in discriminatory or hateful behaviour

We reserve the right to remove content and suspend accounts at our discretion.

7. Ownership & Intellectual Property

All content in our Services is owned or licensed by us and protected by copyright, trademark, and other intellectual property laws.
You may create and share user-generated content (“User Content”) but grant us a perpetual, non-exclusive, worldwide, royalty-free license to use and display it in connection with the Services.

8. Virtual Items Terms

Purchases of in-game currency or virtual items (“Virtual Items”) are a non-refundable, limited license under EU law unless defective or not delivered.

Under the EU Consumer Rights Directive, by purchasing digital content and consenting to immediate delivery, you waive the 14-day withdrawal right.

Virtual Items:

• Cannot be transferred between accounts unless we allow it

• Cannot be sold, traded, or exchanged for real money

• May be changed or discontinued at our discretion

Loot boxes, if present, comply with EU transparency standards and are unavailable in jurisdictions where prohibited.

9. Liability

To the extent permitted by EU law, we are not liable for:

• Losses caused by events outside our control

• Losses due to other users’ actions

• Indirect or consequential losses (e.g., loss of profit)

We remain liable for:

• Death or personal injury caused by our negligence

• Fraud or fraudulent misrepresentation

• Breach of statutory consumer rights

The Services, including all games, apps, and Virtual Items, are provided strictly for entertainment purposes only. They are not intended to provide financial, educational, gambling, investment, or professional advice of any kind. 11. Age Restrictions

Our Services are not directed to children under 18. If you help someone under 18 use our Services, you accept full responsibility for their actions.

12. Sunset Policy (Game Closures)

If a game is shut down, we will provide reasonable notice through in-game notifications or our official channels. Refunds for purchases made in the two months before closure will be available upon request.
